51³Ô¹Ï is committed to preventing and addressing sexual misconduct on our campus or at 51³Ô¹Ï-sponsored events off campus.  Such behavior is unacceptable and will not be tolerated.  The university encourages the reporting of sexual harassment, including sexual misconduct, whenever it occurs.  The university takes steps to respond promptly and effectively to allegations of sexual misconduct.  The university will promptly investigate such incidents and take appropriate action.

Definitions

What is Sexual Harassment?

Sexual harassment is the unwelcome conduct of a sexual nature, including sexual violence. Sexual harassment includes unwelcome sexual advances, requests for sexual favors and other verbal, nonverbal or physical conduct of sexual nature.

What is Sexual Violence?

Physical sexual acts perpetrated against a person’s will or when a person is incapable of giving consent (for example, age or use of drugs or alcohol or other disability prevents the individual from having the capacity to give consent). A number of different acts fall into the category of sexual violence including rape, sexual assault, sexual battery, sexual abuse and sexual coercion.

What is Stalking?

Engaging in a course of conduct directed at a specific person that would cause a reasonable person to fear for safety or suffer substantial emotional distress. Individuals who have been a victim of stalking and/or have a restraining order against another individual should inform Campus Security.

How to File a Complaint

If you have experienced any of the above behaviors on the 51³Ô¹Ï campus, you are encouraged to file a complaint.

1. Go to ngu.edu/title-ix/
2. Select Complaint form from menu.
3. Complete and submit complaint.

Retaliation

The University prohibits retaliation for reporting or participating in the Complaint Resolution Process. Any individual who is subject to or aware of possible retaliation or has other concerns regarding the matter should report these concerns to the Title IX Coordinator, who shall take appropriate action to address such conduct in a prompt and equitable manner.

During any assessment and/or investigation, 51³Ô¹Ï will assist the parties in accessing advocacy resources, academic support, counseling, health or mental health services, and other security and support measures as appropriate, including issuing a no-contact order, arranging a change of living or work assignment or class schedules or making adjustments for assignments or tests, etc.

Bystander Awareness

51³Ô¹Ï believes that risky, potentially dangerous situations can be avoided if a bystander witnesses the event and steps in to intervene. 51³Ô¹Ï encourages students who observe a concerning situation to move past being a bystander and become active.

Here are some tips to become an active bystander:

• Dial 911
• Yell for help
• Intervene directly, if you feel you can safely do so
• Ask a victim if he/she is OK and actively listen to them without telling them what to do
• Suggest that the person submit a Title IX report through the website and/or submit a report directly yourself
• Tell a staff­ person what you observed
